Booking Terms and Conditions
1. Introduction and Parties
1.1. Palette and Trowel is operated by Kane Cunningham and John Oxley ("Palette and Trowel", "us" or "we").
1.2. These terms and conditions, together with the price list and the course information for the relevant course on the Palette and Trowel website (www.paletteandtrowel.co.uk) form the agreement between you and us.
1.3. By booking a Palette and Trowel weekend, you accept these terms and conditions. Your contract is with Palette and Trowel.
2. Palette and Trowel
2.1. Participants on a Palette and Trowel weekend, holiday or tour should be 18 or over.
2.2. An application by you for attendance on a Palette and Trowel weekend, holiday or tour by completing the online booking process will be subject to acceptance by Palette and Trowel. Palette and Trowel reserves the right to refuse an application for attendance.
2.3. No verbal or written correspondence will be entered into with unsuccessful applicants although unsuccessful applicants may apply to other selective Palette and Trowel weekends, holidays or tours.
2.4. In order to get the most from a Palette and Trowel weekend, holiday or tour, you should ensure you arrive promptly and attend each session in full. If you are unable to attend, please let us know via email at firstname.lastname@example.org
2.5. Where your conduct is unacceptable (in Palette and Trowel's reasonable opinion), we reserve the right to request that you leave the Palette and Trowel weekend, holiday or tour. No refund of fees will be made.
2.6. Palette and Trowel will be entitled to change the venue and make minor changes to the timing and content of any Palette and Trowel holiday, weekend or tour. In the unlikely event we have to replace a tutor, we shall make every effort to ensure the replacement tutor has similar expertise to the one advertised. In addition, it may be necessary for Palette and Trowel to re-arrange a single session at a mutually convenient date.
3.1. When booking a Palette and Trowel weekend, holiday or tour online via Eventbrite, full payment of the fee is required.
3.2. For certain Palette and Trowel events, a deposit may be payable (which will be specified on the relevant Palette and Trowel information). Deposits are non-refundable except as set out under Refunds and Cancellations or where your application to attend a Palette and Trowel is not accepted by us.
3.3. The full fee is payable no later than 14 days before the start of the event. If the full fee is not paid by 14 days before the start of the event, Palette and Trowel will be entitled to reallocate your place. You shall remain liable for the fees although we may, at our discretion, refund you a proportion of the fees where we have been able to reallocate your place.
4. Refunds and Cancellations
4.1. You may cancel a Palette and Trowel weekend, holiday or tour if your notification is received by Palette and Trowel a minimum of 14 days prior to the start of the Palette and Trowel weekend, holiday or tour. Provided Palette and Trowel has received your notice of cancellation within this time frame (and acknowledged your notice), Palette and Trowel will refund any fees received from you less the deposit where applicable. Please ensure Palette and Trowel has acknowledged your notice of cancellation. We will not be able to refund you where we did not receive your notice 14 days before the start of the Palette and Trowel weekend, holiday or tour (regardless of when you sent it).
4.2. Palette and Trowel weekends, holidays or tours take place on a specific date, therefore we will not be able to refund you where you do not attend or do not cancel in line with the above. This is because we will have reserved and set aside a specific place for you at the event which we will not be able to fill or resell.
4.3. Palette and Trowel may cancel any Palette and Trowel weekend, holiday or tour at any time prior to its commencement. Except as set out in clause 4.4 below, Palette and Trowel will repay any deposit and fees received from you in respect of the relevant Palette and Trowel. Please note that Palette and Trowel will not refund travel costs or accommodation costs for cancelled courses.
4.4. There is no entitlement to a refund where Palette and Trowel is forced to cancel part or all of a Palette and Trowel weekend, holiday or tour due to reasons beyond our reasonable control. However, refunds may be paid at Palette and Trowel's discretion.
4.6. We regret we cannot offer refunds where we have to change tutors or venues.
5. Feedback and Complaints
5.1. Palette and Trowel weekends, holidays or tours are designed to provide an enjoyable and high-quality experience for those attending. At the end of each Palette and Trowel, we will provide an evaluation form, which will offer you the opportunity to provide feedback.
5.2. In the event of a complaint, please make your complaint via email to email@example.com within 7 days of the Palette and Trowel ending. We take any complaint seriously and will aim to investigate and respond as quickly as possible and in any event within 28 days.
6.1. Nothing excludes or limits Palette and Trowel's liability for personal injury or death due to its negligence.
6.2. Please ensure you take care of your personal possessions as Palette and Trowel cannot accept any liability for them.
6.3. Palette and Trowel will not be liable for any loss or damage suffered by you resulting from any events which are beyond the reasonable control of Palette and Trowel.
6.4. Subject to the above, Palette and Trowel's liability to you is limited to the fees you have actually paid for the relevant Palette and Trowel.
8.1. It is a condition of booking that all travellers be covered by comprehensive travel insurance and do not travel against medical advice. You should organise it immediately you book so as to be covered in case of the ill health of yourself, a close relative or your travelling companion. We do not check insurance policies; however we request written details (insurer’s name, policy number and emergency contact number) no later than 4 weeks prior to departure. You are responsible for indemnifying us in full in the event that we incur any losses or expenses arising out of your failure to take out adequate insurance cover.
9. Special Requests
9.1. If you have any special requests, please inform us of these in writing at the time of booking. We will advise the relevant suppliers but cannot guarantee that they will be met. Furthermore, Palette and Trowel has no liability to you if such requirements are not met. We regret we cannot accept any conditional bookings, i.e. any booking which is specified to be conditional on the fulfilment of a particular request.
10.1. You must be fit and well to take part on one of our weekends, holidays or tours. Our archaeological programmes involve a great deal of walking in cities or scrambling over rough terrain on archaeological sites which can be difficult to negotiate and physically tiring. We rely on your assessment of your own ability to participate in a tour. If you have any reservations regarding your fitness for a trip, please ring us. Under no circumstances should you travel if your doctor has or would advise against it. If you are infirm, disabled or unfit in any way or have any medical condition which will or may affect your tour arrangements, it is imperative that you inform Palette and Trowel so that we may give you advice as some of the weekends might be very unsuitable or even dangerous for you. If you know that you need help, you should bring a helper with you, whose participation is subject to availability and the full weekend price. Palette and Trowel reserves the right to refuse to take participants who have not provided all relevant details of any medical condition, disability, infirmity or other factors which affect your ability to fully participate in the holiday at the time of booking or as soon as any such condition etc. develops, if later. Bookings are accepted on the understanding that they appreciate the possible risk inherent in archaeological travel and that they undertake the tours, walks or expeditions featured in our brochure, on that basis.
11. Website Accuracy
11.1. Palette and Trowel reserves the right to change any of the prices, services or other particulars contained in this website at any time before we enter into a contract with you. If there is any significant change, we will notify you before you enter into such contract. All information is given in good faith and believed correct at the time of printing. Whilst every effort is made to ensure accuracy, occasional errors do occur and you must therefore check your weekend, holiday or tour details carefully.
12.1. The contract contains all the terms agreed between you and Palette and Trowel.
12.2. This agreement shall be governed by and construed in accordance with English law and the parties agree that the English courts shall have non-exclusive jurisdiction in relation to this agreement.
